Terms & Conditions of Sale

1. Ownership. Qube Books is a division of Pencil-Sharp Ltd, whose registered office is at Unit F8, Rake Industries, Rake, Nr Petersfield, Hants GU31 5DU, UK.

2. Data Protection. Pencil-Sharp Ltd is fully registered under the Data Protection Act 1998. Any personal information shared with us shall only be used to notify you of further Qube developments and shall not, under any circumstances, be shared with a third party.

3. Comment and feedback. Users of this website may post their comment and feedback to the editor at editor@qubebooks.com as long as the content is not illegal, obscene, abusive or threatening, defamatory, invasive of privacy, infringing of any intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of ‘spam’. You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any content.

4. Customer mailing list. Customers wishing to be added to our e-mailing list should email info@qubebooks.com. Customers should submit only their own email address, rather than on behalf of any third party. Email addresses received in this manner will not be added to our mailing list.

5. Confidentiality. Our online billing is managed by Barclays Bank plc and any bank details you give at the point of sale are shared securely with the bank alone.

6. Accessibility. We will do our utmost to ensure that availability of the website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

7. Copyright. All content included on the website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations and software, is the property of Pencil-Sharp Ltd and is protected by international copyright, author’s rights and database right laws. You may not systematically extract and or re-utilise any part of this website without the express written consent of Pencil-Sharp Ltd.
a) Unless you have been sent a complimentary graphic by Qube, graphics for use as screensavers, wallpapers, presentational graphics or other electronic or printed use, should be purchased from the site. Graphics obtained in this way are deemed to have been sold for individual use and thus permission granted under copyright law. Individual graphics may then be used by the purchaser, but not shared with others for their independent use. Additional copyright fees are payable for the sequential use of two or more graphics – whether in electronic presentation or in printed form. Please direct all permissions correspondence to Copyright permissions – permissions@qubebooks.com.
b) Otherwise, graphics originating from this site may not be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, without the prior permission of Pencil-Sharp Ltd or a licence permitting restricted copying. In the UK such licences are issued by The Copyright Licensing Agency, 90 Tottenham Court Road, London, WP1 9HE.

8. Contract. When you place an order to purchase a product from Pencil-Sharp Ltd, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product, which is then accepted by us when we send a confirmation to you that we have dispatched that product to you. That acceptance is formalised and completed when we send a subsequent dispatch confirmation email to you. The details of that confirmation constitute the contract.

9. Statutory cooling off period. Customers in the European Union are entitled to a statutory cooling off period of seven business days, in which they may cancel their order without cost.

10. Refunds. If for any reason you are unhappy with your purchase, you are eligible for a full refund, so long as the item is returned in its original condition within 30 days of the date you received it. Delivery and return costs can only be refunded on orders of over GBP £5.

11. Exchanges. We are unable to exchange items that are not damaged, defective or incorrect.

12. Refund process. When we receive your returned item(s), we will notify you via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase within three weeks of our receiving your return. If the return and refund do not appear in your account after four weeks from the day you sent us your return, please contact customer services for further assistance.

13. Pricing and availability. We list availability information for our products on the website. Orders should be dispatched within 5 business days of receipt. Dispatch estimates are estimates alone and should not be seen as guaranteed dispatch times. You will be informed by email if any products you have ordered turn out to be unavailable. In the event of miss-pricing, you will be charged the lower amount, whatever the actual price.

14. Customs. Overseas deliveries may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by the customer; we have no control over these charges and cannot predict what they may be.
